Common Misconceptions Surrounding Filing a Lawsuit

On Behalf of Garber Law, P.C. | Jun 11, 2024 | Personal Injury

Lawsuits are filed by people every single day, yet despite this it is extremely possible that many Americans do not know or are not aware of many of the procedures and actions that surround the very common practice. In fact, there are several misconceptions that people have when it comes to filing a lawsuit, ones that the majority of people would find interesting to learn the truth about. From what type of people usually file a lawsuit to how many of them actually end up going to court – the answers of what really happens during this course of action may surprise you.

Filing a Personal Injury Lawsuit

Certain types of people never even think about filing a lawsuit for they do not consider or even want to consider themselves the suing “type.” That being said what they do not realize is that the majority of people who end up filing a lawsuit were not the filing type either. Not only that, most times these types of cases end up being settled way before they even see a courtroom and no official suit ends up getting filed at all. Lawyers will almost always do their best to reach a fair settlement without going to trial, and the act of hiring a lawyer does not mean you have to go to court. Rather, it is just a way to have someone deal with their insurance company on their behalf without having to do it themselves. If you believe you may have a case and want to go see a lawyer it is important to know that suing someone is not your first line of defense and that it is very possible your case will not have to see the light of day if you get a fair settlement. There is also the advantage of hiring a personal injury lawyer to deal with your insurance company in a personal injury case because it is their job to deal with these types of companies daily and they will be more educated on exactly what to say to them as well as what the company will be looking for. Since adjusters know that most regular people are not aware of all of the options that are available to them they can clearly take advantage of the situation and possibly get one over on those who do not know any better. Having an attorney who will handle these issues instead is a great stress relief to those who do not wish to learn all about the law process when trying to be compensated after an injury.

Schedule a Consultation With a Personal Injury Lawyer

There are many people who are afraid of the process of filing a lawsuit when the reality is most cases will never even get to court. You need a knowledgeable attorney who will guide you through this confusing process and can get you the settlement you are entitled to.
